Protection of the Reserve and of entitlements

1. The assets of the Reserve and the entitlements of holders shall not be cancelled, written down, compulsorily redeemed, seized, transferred, suspended, lent, encumbered or otherwise applied, in whole or in part, for the benefit of the general budget of the Union, of any Member State or of any public body, by any act of the Union or of a Member State.

2. The Reserve shall not acquire or hold, directly or indirectly, debt instruments issued or guaranteed by the Union, by a Member State, by a regional or local authority of a Member State, by a central bank or by any body the obligations of which are guaranteed by any of them.

3. This Regulation shall not be interpreted as authorising any authority of the Union or of a Member State to derogate from paragraphs 1 and 2.

4. Every holder, and every national vehicle acting for its holders, shall have the right to an effective remedy before a court or tribunal against any act or omission infringing this Article, in accordance with Article 47 of the Charter of Fundamental Rights of the European Union.
