The ask
We are preparing an initiative asking the Commission to assess and propose instruments for citizens to share in gains from hyper-automated production. The registration objectives are the request; the 3 % warrant Regulation illustrates one mechanism. Neither has been registered.
How the illustrative draft works
- Designation. The Commission assesses durable decoupling of production from employment. Thresholds create a rebuttable presumption; investigation can also lead to designation below them.
- Warrant. Within three months of designation, a company issues a non-voting warrant for shares representing 3 % of fully diluted capital, subscribed at nominal value, subject to Article 5's cap.
- Triggers. The first liquidity event, shareholder extraction above the Article 5 threshold, or the seven-year long-stop triggers subscription. Settlement is in shares; it does not itself produce cash for payouts.
- Entitlement. EU citizens aged 18 or older would share equally in declared distributions. The right cannot be sold, pledged or redeemed. No means test; registration with a national vehicle is needed for payment. Available income determines distributions, which may be zero.
Legal basis
Articles 114 and 352 TFEU are proposed, contested bases. Article 352 requires unanimity. Registration would not approve the draft's legality or guarantee its adoption; partial registration may change what can proceed.
The central objection
The share obligation might be classified as a fiscal measure. Settlement in shares outside public budgets does not settle that question. The objections explain the challenge and the project's response. Protections against diversion cannot prevent all future legislative changes.
Status: 6 September 2026
No filing, registration or signature collection. The Forum advised on 27 August; an ECI veteran responded on 5 September. Both are independent feedback, not institutional approval. Recruitment continues. The initiator pays hosting and review costs; no organisation or donations are recorded.
