Monitoring and evaluation
1. The Commission shall monitor, on the basis of data published by the European Central Bank, Eurostat and the national statistical institutes:
(a) the diffusion of automated cognitive systems among undertakings in the Union;
(b) the distribution of household holdings of equity instruments in the Union;
(c) the share of value added accruing to labour and to capital in the sectors in which covered undertakings operate;
(d) the number of designations, crystallisations and distributions under this Regulation and their amounts.
2. By 31 December 2032, and every three years thereafter, the Commission shall evaluate this Regulation and submit a report to the European Parliament, the Council and the European Economic and Social Committee.
3. The report shall state, on the basis of the indicators in paragraph 1, whether the premise of this Regulation that gains from automated cognitive systems accrue disproportionately to the holders of the systems remains supported by the evidence. Where the report finds that the share of undertakings referred to in point (a) of paragraph 1 exceeds one quarter and that neither the indicator in point (b) nor the indicator in point (c) of that paragraph shows the concentration the premise predicts, the report shall say so expressly and shall be accompanied, where appropriate, by a proposal for the amendment or repeal of this Regulation.
4. Where a report under paragraph 2 accompanies or precedes a proposal for the amendment of Article 5, Article 8, Article 10 or Article 12, it shall include an independent assessment of the effect of the proposal on the entitlements of holders.
5. The report shall be published.
